Terms and Conditions of Use Article 1 (Purpose) The purpose of the present terms and conditions of use lies in determining the rights, obligations, and responsibilities of the Seoul National University Human Rights Center and users in the use of services related to the online human rights education (hereafter “services”) provided by the website operated by the Seoul National University Human Rights Center (hereafter “the website”). Article 2 (Definitions) ① “The website” signifies the website operated by the Seoul National University Human Rights Center to provide users with contents and diverse services (http://hrc.snu.ac.kr). ② “Users” signifies members and non-members who access the website and receive the services provided by the Seoul National University Human Rights Center in accordance with the present terms and conditions of use. ③ “Services” signifies all acts of provision of the contents provided to users by the Seoul National University Human Rights Center through the website and diverse related acts including the provision of information on education completion. ④ “Contents” signifies all information provided by the Seoul National University Human Rights Center through the website and “data or information expressed through codes, letters, voices, sounds, images, or video recordings used in information and communications networks” stipulated in Article 2 Clause 1(1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. ⑤ “Members” signifies individuals who have accessed the website, concluded a contract in accordance with the present terms and conditions of use, and been issued a user name and a password and those who have accessed the website by using the user names and passwords for the Seoul National University portal mySNU (hereafter “mySNU”). ⑥ “Membership admission” signifies members’ conclusion of a contract with the Seoul National University Human Rights Center in accordance with the present terms and conditions of use to be provided with services. ⑦ “User name” signifies the combination of letters and numbers determined by members and approved of and granted by the Seoul National University Human Rights Center for members’ identification and use of services. ⑧ “Password” signifies the combination of letters and numbers determined and managed by users themselves to verify that they are the users who match the user names in using the services and to protect users’ personal information. ⑨ “Member information” signifies the information that individuals who wish to become members register on the website through the completion of the online membership application form presented by the Seoul National University Human Rights Center and the information on members transmitted to the Seoul National University Human Rights Center from mySNU. ⑩ “Administrator” signifies the individual selected by the Seoul National University Human Rights Center to manage and to operate the services provided. Article 3 (Effect and Revision of the Terms and Conditions of Use) ① The present terms and conditions of use are to take effect when users consent to their contents and apply for membership and the Seoul National University Human Rights Center approves of the application. ② The Seoul National University Human Rights Center is to post the contents of the present terms and conditions of use on the initial screen or the connected screen for users’ easy access. However, it may allow users to view the contents of the terms and conditions of use through the connected screen. ③ The Seoul National University Human Rights Center may revise the present terms and conditions of use insofar as it does not violate related laws including the Personal Information Protection Act, Digital Signature Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., and Framework Act on Consumers. ④ When the Seoul National University Human Rights Center revises the present terms and conditions of use, it is to announce clearly the application date and the reasons for the revisions on the initial screen or the connected screen from seven days before the application date to one day before the application date. ⑤ When the Seoul National University Human Rights Center revises the present terms and conditions of use, it is to confirm users’ consent to the application of the revised terms and conditions of use. ⑥ When users continue to use the services after the effective date of the revised terms and conditions of use without expressing rejection, they are to be seen as having consented to the revised terms and conditions of use. ⑦ When users do not consent to the revised terms and conditions of use, they may personally withdraw from membership through the website. ⑧ As for matters not determined in the present terms and conditions of use and interpretation of the present terms and conditions of use, they are to follow the Act on the Consumer Protection in the Electronic Commerce Transactions, Etc., Regulation of Standardized Contracts Act, and other related laws. Article 4 (Membership Application and Approval) ① Membership admission occurs when individuals who wish to become members (hereafter “membership applicants”) are fully knowledgeable of the contents of the present terms and conditions of use and of the personal information processing policy, select “Consent,” and apply for membership by completing the online membership application form presented by the Seoul National University Human Rights Center, and the Seoul National University Human Rights Center approves of the application for use. ② The Seoul National University Human Rights Center may disapprove of membership applications or disqualify users even after their admission as members in any of the following cases: 1. When users have failed to use their actual (legal) names 2. When users have provided false information and/or misappropriated other individuals’ names or personal information 3. When users have used multiple user names 4. When approval is impossible due to causes imputable to users 5. When individuals have failed to complete the membership application form presented by the Seoul National University Human Rights Center 6. When membership applicants do or will not be members of Seoul National University and/or do or will not work at Seoul National University 7. When individuals have lost eligibility as members due to violations of the present terms and conditions of use and/or related laws 8. When it is inappropriate to approve of membership applications due to other reasons ③ The Seoul National University Human Rights Center may reserve approval of membership applications when there are technical or operational problems in relation to the services. Article 5 (Changes to Member Information) ① When applying for membership, membership applicants must enter mandatory items in the membership application form presented by the Seoul National University Human Rights Center on the membership application screen of the website without fail. ② Members may make requests to the Seoul National University Human Rights Center for the viewing of the member information that they have entered in the membership application form through the website. ③ When there are changes to the items entered in the membership application form, members must personally modify them through the website. The Seoul National University Human Rights Center is not responsible for problems that arise because members have failed to modify their member information. Article 6 (Members’ Obligations) ① Members must provide only accurate and truthful information when applying for membership. When there are changes to information such as their affiliation and status/post, they must personally access the website and modify the relevant information. ② Members have the responsibility to manage their user names and passwords and must not allow third parties to use them. ③ When members learn that their user names and passwords have been divulged and used by third parties, they must notify the Seoul National University Human Rights Center of the fact immediately. ④ In the case of the clause above, the Seoul National University Human Rights Center may demand members to take necessary measures such as changing their passwords to protect members’ personal information and to prevent the wrongful use of the services. ⑤ Members must not engage in any wrongful use of the services including the completion of human rights education through wrongful means and/or the reception of certificates of education completion through wrongful means. ⑥ In the case of the clause above, the Seoul National University Human Rights Center may take necessary measures including the termination of the provision of services to the relevant members and/or the notification of the departments to which the relevant members belong of the fact. ⑦ Members must use the services provided by the Seoul National University Human Rights Center in accordance with customary methods of use ⑧ The Seoul National University Human Rights Center is not responsible for disadvantages suffered by members due to their failure properly to fulfill the obligations stipulated in the present article. Article 7 (Withdrawal and Disqualification from Membership) ① When members wish to withdraw from membership, they must personally apply for membership withdrawal through the website. ② When members have committed any of the following acts in relation to the use of the services, they may be restricted or disqualified from the use of the services without prior notification: 1. When members have misappropriated others’ personal information, user names, and/or passwords 2. When members have entered false member information 3. When members have intentionally interfered with the operation of the services 4. When the same individual has registered two or more disparate user names 5. When members have committed violations of the intellectual property rights of the Seoul National University Human Rights Center including the reproduction (copying) and/or distribution without prior permission and/or the wrongful use of the contents provided through the website 6. When members have committed other violations of the present terms and conditions of use and/or related laws 7. When members have committed other acts that violate public morals and/or social order ③ When members fail to re-consent (every two years) to the collection and use of personal information, they will be automatically withdrawn from membership even without membership withdrawal applications. Article 8 (Provision of and Changes to Services) ① The Seoul National University Human Rights Center performs the following duties: 1. Provision of human rights education contents 2. Provision of services entailed by the provision of human rights education contents 3. Other duties determined by the Seoul National University Human Rights Center ② When changing the contents of the services to be provided due to reasons including changes to the operational and/or technical specifications, the Seoul National University Human Rights Center is to post the reasons through “Notices.” Article 9 (Termination of Services) ① The Seoul National University Human Rights Center may restrict or terminate services wholly or partly in any of the following cases: 1. When incidents such as the repair, inspection, replacement, breakdown, and/or transmission interruption of information and communications facilities including computers occur 2. When there are difficulties with the normal use of the services due to reasons including an overload on the services used 3. When it is necessary to terminated the serviced due to inevitable reasons including power outage, natural disasters, and/or national emergencies 4. When cases determined by the Seoul National University Human Rights Center as appropriate including the replacement of the services arise ② In the case of the clause above, the Seoul National University Human Rights Center is to notify users through “Notices.” Article 10 (Personal Information Protection) ① The Seoul National University Human Rights Center collects minimal personal information necessary to implement the services. Categories 1-6 below are mandatory: 1. Name (Korean script/Roman alphabet) 2. Date of birth 3. Status/post 4. Affiliation 5. User name 6. Password 7. E-mail address 8. Gender 9. Mobile telephone number ② When collecting personal information through which individuals can be identified, the Seoul National University Human Rights Center obtains users’ consent without fail. ③ The personal information provided may not be used outside the purposes stipulated and/or be provided to third parties without the relevant users’ consent. However, exceptions are to be made in the following cases: 1. When personal information is necessary for statistics, academic research, and/or market surveys and is provided in a form that makes it impossible to identify the relevant individuals 2. When personal information is necessary for verifying users’ identities to prevent its misappropriation 3. When the use and/or provision of personal information are necessary and inevitable due to legal stipulations or laws ④ Users may make requests at any time for the viewing and/or correction of their personal information retained by the Seoul National University Human Rights Center, and the Seoul National University Human Rights Center has an obligation to take necessary measures regarding such requests without delay. When users have demanded the correction of errors, the Seoul National University Human Rights Center is not to use the relevant users’ personal information until it has corrected the errors. ⑤ When two years have passed from users’ initial date of membership admission, the Seoul National University Human Rights Center is to delete the personal information stipulated in Article 1 of the present terms and conditions of use. However, it is not to do so when users access the website and re-consent to the collection and use of their personal information before the two-year period has passed. ⑥ Even in the case of the main text of the clause above, the Seoul National University Human Rights Center may retain the personal information of individuals who have completed human rights education up to one year from the date of the completion of education within the scope of the issuance of certificates of education completion. In such a case, personal information that may be retained and used is to be restricted to the categories in Clause 1①-④ of the present article, details of the education completed, and time/date of education. Article 11 (Obligations of the Seoul National University Human Rights Center) ① The Seoul National University Human Rights Center is not to engage in acts prohibited by laws and the present terms and conditions of use and must do its utmost to provide services in a continuous and stable manner in accordance with the present terms and conditions of use. ② The Seoul National University Human Rights Center must establish a security system for protecting users’ personal information to enable users to use Internet services safely. Article 12 (Attribution of Copyright and Restriction of Use) ① The copyright and other intellectual property rights to all contents and related data provided by the Seoul National University Human Rights Center belong to the Seoul National University Human Rights Center. ② As for information to which intellectual property rights belong to the Seoul National University Human Rights Center out of the information obtained by using the website, users must not use for profit and/or allow third parties to use the information through reproduction, editing, transmission, exhibition, publication, distribution, broadcasting, performance, sales, and/or other means without prior permission of the Seoul National University Human Rights Center. Article 13 (Wrongful Use of the Services) ① Any of the following cases constitutes wrongful use of the services: 1. When users simultaneously access the website from two or more personal computers by using the same user name 2. When users allow others to use their user names and/or services including courses 3. When users sell, lease, or transfer their user names and/or services including courses to others and/or advertise such acts 4. When users run reproduction (copying) programs, make recordings, and/or attempt to do so while using the services 5. When users are issued certificates of education completion even when they have not actually completed the courses provided by the website Article 14 (Dispute Resolution) The Seoul National University Human Rights Center processes by priority complaints and opinions submitted by users. However, when prompt processing is difficult, users will be notified immediately of the reasons and the processing schedule. Addenda (Effective Date) The present terms and conditions of use are to be implemented starting July 22, 2013.
